Judiciary cannot snatch our fundamental rights: Maulana Umari

The president of Jamaat-e-Islami Hind (JIH), Maulana Syed Jalaluddin Umari, reacted sharply to the latest Allahabad High Court observation regarding triple talaq and said: “the judiciary cannot snatch our fundamental rights duly sanctioned by the Constitution of India.”

The JIH chief said: “Every section of Indian society has been given certain fundamental rights by the Constitution of India. One important fundamental right is the freedom to follow one’s religion and its personal laws. The judiciary should not interfere in this as Muslims are following their religion and personal laws duly sanctioned by the Constitution of India. It is not a question of Muslims alone. Followers of other religions like Hindus, Christians, Sikhs and Jains too follow their own personal laws and the Courts should not interfere in them. The High Court observation was totally uncalled for when the Supreme Court was already seized of the matter.”

Maulana Umari said: “Yes, triple talaq in one sitting is highly undesirable and Muslims are advised to refrain from that practice, but in certain conditions and situations, it might be required. Although triple talaq is not the recommended way to divorce, once given it becomes valid. We advise Muslims to avoid believing in rumors, observe restraint under such provocation and rally solidly behind the All India Muslim Personal Law Board.”
